JTP Prints is a fine art photography print business operated by James Pugh.

These terms and conditions apply to purchases made through the JTP Prints website and form part of the agreement between you and JTP Prints.

2. Products and photographs

All photographs displayed on this website are original photographic works by James Pugh unless otherwise stated.

Prints are produced using professional photographic printing equipment and fine art papers selected for their quality, appearance and longevity.

Product images shown on the website are intended as an accurate representation of the finished print. However, slight differences in colour may occur between the image displayed on your screen and the physical print due to differences in monitors, devices and screen settings.

Prints are supplied unframed and with a defined border.

3. Pricing and payment

All prices displayed on the website are in pounds sterling (£) and are the prices applicable at the time the order is placed.

Delivery charges are shown separately and are added to the order total before payment is completed.

Payment must be made in full when placing an order.

JTP Prints reserves the right to correct obvious pricing errors or errors in product information. If an order has been placed using an obviously incorrect price, you will be contacted before the order is fulfilled.

4. Orders

Once an order has been placed, you will receive confirmation of your order by email.

Please check your order confirmation carefully and contact JTP Prints as soon as possible if any information is incorrect.

JTP Prints reserves the right to decline or cancel an order where there is a genuine reason that the order cannot be fulfilled.

If an order is cancelled by JTP Prints after payment has been received, you will receive a full refund of the amount paid.

5. Delivery

Prints are carefully packaged and sent using Royal Mail.

Delivery charges and estimated delivery times are displayed on the Delivery & Shipping page and during the checkout process.

Delivery times are estimates rather than guaranteed delivery dates. Once an order has been handed to the delivery service, delivery times may be affected by circumstances outside the control of JTP Prints.

If your order does not arrive within a reasonable period, please contact JTP Prints so that the matter can be investigated.

6. Returns and cancellations under these terms and conditions

If you purchase a standard, non-personalised print online, you may have a statutory right to cancel your order under UK consumer law.

Where the statutory cancellation right applies, you generally have 14 days from the day after receiving the goods to notify JTP Prints that you wish to cancel. The goods should then be returned in accordance with the applicable cancellation rules.

Prints must be returned in an unused and undamaged condition. Customers are responsible for taking reasonable care of the goods while they are in their possession.

This does not affect your statutory rights where an item is faulty, damaged, not as described or otherwise does not meet the requirements of consumer law.

Certain goods may be exempt from the standard cancellation right, including goods that are made to the customer’s specifications or clearly personalised.

7. Damaged or faulty prints

Every print is checked before being packaged and dispatched.

If your print arrives damaged or you believe it is faulty, please contact JTP Prints as soon as reasonably possible, ideally with photographs showing the condition of the package and print.

Where an item is faulty, damaged or does not conform to the description, your statutory consumer rights will apply.

Depending on the circumstances, this may include a replacement, repair, price reduction or refund in accordance with your statutory rights and these terms and conditions.

8. Bespoke and commissioned work

JTP Prints may accept commissions for bespoke photography and photographic prints.

Commissioned work will be discussed and agreed with the customer before work begins. This may include the subject, location, photographic requirements, print size, materials, timescale and price.

Because commissioned work may be created specifically to the customer’s requirements, cancellation and return rights may differ from those applying to standard, non-personalised prints.

Any specific terms relating to a commission will be agreed with the customer before payment is taken.

9. Copyright and ownership

All photographs, images, text and other original content displayed on this website remain the intellectual property of James Pugh unless otherwise stated.

Copyright in the photographs remains with James Pugh. Purchasing a print does not transfer copyright or ownership of the underlying photograph.

The purchase of a physical print grants the purchaser the right to own and display that physical print for personal use. It does not grant permission to reproduce, scan, copy, distribute or commercially exploit the photograph.

11. Colour and appearance

Every effort is made to ensure that photographs displayed on this website accurately represent the finished prints.

However, colours and tones may appear slightly different depending on the screen, monitor, browser and display settings used to view the website.

Minor variations in paper texture, finish and colour rendering are a natural characteristic of fine art printing and do not necessarily indicate a defect.

12. Liability

Nothing in these terms excludes or limits any liability that cannot legally be excluded or limited under UK law.

JTP Prints will not be responsible for losses caused by circumstances outside its reasonable control, including significant disruption to postal services or other events beyond reasonable control.

Nothing in these terms and conditions affects your statutory consumer rights.

13. Privacy

Personal information provided when placing an order or contacting JTP Prints will be handled in accordance with the JTP Prints Privacy Policy.

Personal information will only be used for legitimate business purposes, including processing orders, arranging delivery, responding to enquiries and providing customer support.

14. Changes to these terms and conditions

JTP Prints may update these terms from time to time. The version published on this website at the time an order is placed will apply to that order.

These terms and conditions may be amended where necessary to reflect changes to the business, products, services or applicable legal requirements.

15. Governing law

These terms and conditions are governed by the laws of England and Wales.

Any disputes will be subject to the jurisdiction of the courts of England and Wales, subject to any rights you may have as a consumer under applicable law.
